Terms of Service

These Terms of Service ("Terms") govern your use of the EZpark NYC mobile application, website, and related services (collectively, the "Service") operated by EZpark NYC ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

Important: EZpark NYC is a technology platform that helps drivers find parking information and connect with driveway hosts. We are not a parking garage operator, landlord, insurance provider, or law enforcement authority. We do not guarantee that any spot is available, legal, safe, or suitable for your vehicle.

1. Eligibility

  • You must be at least 18 years old to use the Service.
  • You must provide accurate registration information and keep it up to date.
  • You are responsible for all activity under your account.
  • You may not use the Service if you are barred under applicable law or previously suspended from the Service.

2. The Service

EZpark NYC includes features such as:

  • Community spots: user-reported street parking information
  • Driveway listings: hosts offering private driveway space
  • Booking requests: drivers requesting to park at a listed driveway
  • In-app messaging: communication between users about spots or bookings
  • Payments: processing of booking payments through Stripe
  • Reputation scores: trust indicators based on user activity

Features may change, be added, or be removed during beta or future updates. We may modify or discontinue the Service at any time.

3. Community-reported spots

  • Spot reports are created by other users and are not verified by EZpark NYC.
  • A reported spot may already be taken, may not exist, or may not be legal for your vehicle or situation.
  • You are solely responsible for reading street signs, meter rules, alternate-side regulations, driveway access, and all applicable New York City and New York State parking laws before parking.
  • False, misleading, or abusive spot reports may result in loss of reputation points, restrictions, or account termination.
  • Confirming or denying spot availability should reflect your honest observation.

4. Driveway listings and hosting

  • If you list a driveway, you represent that you have the legal right to offer the space for parking and that your listing information (address, availability, price, photos, and description) is accurate.
  • You are responsible for local laws, HOA or building rules, permits, insurance, taxes, and any agreements with landlords or co-owners.
  • You must provide safe, reasonable access instructions and respond to booking requests in good faith.
  • You may not list public street space, spaces you do not control, or spaces where parking would violate law or property rights.

5. Booking requests

  • Drivers submit requests; hosts choose whether to accept or decline.
  • A booking is not confirmed until a host accepts the request.
  • Both parties should communicate promptly through the app and honor agreed arrival and departure times when possible.
  • Either party may cancel according to in-app flows and applicable payment rules. Repeated no-shows or abuse may lead to account action.

6. Payments, fees, and Stripe

  • Payments for accepted driveway bookings are processed by Stripe. We do not store full payment card numbers.
  • Hosts must connect a valid Stripe account to receive payouts. Stripe's terms and verification requirements apply to hosts.
  • EZpark NYC may charge a platform service fee (currently 10%) on completed bookings. Fees may change with notice in the app or on this page.
  • Refunds, chargebacks, and payment disputes are handled according to Stripe policies, booking status, and our review of the situation. We may withhold or reverse payouts when fraud or policy violations are suspected.
  • Hosts are responsible for their own tax reporting and obligations related to income earned through the Service.

7. Messaging and user conduct

  • Use in-app chat only for legitimate coordination about spots, listings, or bookings.
  • You may not harass, threaten, spam, discriminate against, or solicit users to bypass platform payments for marketplace bookings.
  • We may review, restrict, or remove messages that violate these Terms or create safety risks, as described in our Privacy Policy.

8. Reputation and trust scores

Reputation scores and badges are automated indicators based on in-app activity. They are provided for convenience only and do not guarantee a user's reliability, honesty, or suitability. We may adjust scoring systems at any time.

9. Your content and our license

You retain ownership of content you submit (reports, listings, photos, messages, reviews, and similar material). By submitting content, you grant EZpark NYC a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use that content as needed to operate, promote, and improve the Service.

You represent that your content does not infringe others' rights and that you have permission to upload photos and listing details.

10. Prohibited use

You agree not to:

  • Provide false listings, spot reports, or identity information
  • Scrape, reverse engineer, or copy the Service or its underlying code
  • Circumvent security, payment flows, or access controls
  • Use the Service for unlawful, dangerous, or fraudulent activity
  • Impersonate another person or misrepresent your affiliation
  • Upload malware, abusive content, or content that violates others' privacy

11. Moderation and termination

We may warn, restrict, suspend, or terminate accounts that violate these Terms, create safety or legal risk, or harm other users or the platform. You may delete your account in the app or contact us for assistance.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the above, we do not warrant that:

  • Any spot or driveway will be available when you arrive
  • Any host will accept your booking request
  • Parking at a reported spot or booked driveway is legal or ticket-free
  • The Service will be uninterrupted, error-free, or secure

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZPARK NYC AND ITS OPERATORS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PARKING-RELATED FINES, TOWING, TICKETS, PROPERTY DAMAGE, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE SERVICE OR INTERACTIONS WITH OTHER USERS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EZPARK NYC IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless EZpark NYC from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your listings, your parking activity, or your violation of these Terms or applicable law.

15. Disputes between users

Disputes between drivers and hosts (including property damage, access issues, or payment disagreements) should first be addressed directly between the parties and through in-app support. EZpark NYC may assist at its discretion but is not obligated to mediate every dispute.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where prohibited by applicable consumer protection law in your jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
